Will the Ontario court take jurisdiction over your case even though there are foreign parties?




In a connected world, so many transactions, from an Uber drive to buying on Amazon, are cross-border transactions that every Ordinary Joe is carrying on a couple of such international contract transactions every year, sometimes without even knowing it. When there is a dispute, what will the Canadian courts do? will they take your claim or force you to go fight in another forum? What if you signed a contract choosing England as the law and English courts as the chosen court? in the below case, the Ontario Court of Appeal maintained the case in Ontario even though there was a ‘forum selection’ clause in the contract.
